Getty Sues Stability AI Over Copyright Infringement

Stock image service Getty Images has initiated a lawsuit against Stability AI, the creator of the popular text-to-image tool Stable Diffusion, over alleged copyright violations. Unlike many competitors, Stable Diffusion can operate on personal computers, making it a preferred choice for many users. Recently, Apple has shown its support for the Stable Diffusion project, enhancing its performance on M-powered Macs, which can now generate images in under 18 seconds.

The rise of text-to-image generators like Stable Diffusion has sparked concern among human artists, who argue that their works have been used to train such models without their consent or proper compensation. In response, Getty Images claims that Stability AI unlawfully copied and processed millions of copyrighted images owned by them.

In a statement, Getty Images expressed, “This week, Getty Images commenced legal proceedings in the High Court of Justice in London against Stability AI, claiming that Stability AI infringed upon intellectual property rights, including copyright, in content owned by Getty Images. Our stance is that Stability AI unlawfully utilized millions of images, along with associated metadata, without a proper license to further their commercial interests, negatively impacting the creators of this content.”

While images for training competitors like DALL-E 2 have not been disclosed, Stability AI has been open about the training data of its model. However, this transparency may have now placed Stability AI in a challenging legal position. An analysis of 12 million of the 2.3 billion images used for Stable Diffusion’s training revealed a significant number were sourced from stock image websites, including 123RF and Adobe Stock.

Additionally, user-generated platforms such as Pinterest, WordPress, and DeviantArt contributed to the compilation of images used for training purposes. Concerns regarding the use of copyrighted content to train AI models seem justified, potentially paving the way for a rise in similar lawsuits unless a balance is struck between AI training and honoring the rights of human creators.

In a related development, Shutterstock announced an expanded partnership with OpenAI, the creator of DALL-E, aimed at creating frameworks to ensure that artists are compensated when their intellectual property is used in AI developments.
