Clearview AI Faces Potential £17M Fine from UK Privacy Watchdog

Clearview AI is once again under scrutiny, this time from the UK’s Information Commissioner’s Office (ICO). The controversial facial recognition company has drawn the attention of privacy regulators and advocates due to its practice of collecting personal images from the internet without explicit consent.

Reportedly, Clearview AI has amassed a database of over 10 billion images. As noted by Clearview AI lawyer Tor Ekeland, “Common law has never recognized a right to privacy for your face.” In response to concerns, the ICO has initiated a joint investigation with the Office of the Australian Information Commissioner (OAIC) regarding Clearview AI’s actions.

Earlier this month, Australian Information Commissioner Angelene Falk concluded that simply uploading an image to a social media platform does not constitute consent for that image to be collected by an unknown third party for commercial use. Consequently, Falk mandated that Clearview AI eliminate the biometric data it collected from Australians and halt any further data collection.

In a recent update, the ICO revealed its intention to impose a fine exceeding £17 million on Clearview AI, while also requiring the deletion of personal data held on UK citizens and the cessation of any further data processing. UK Information Commissioner Elizabeth Denham emphasized her concerns regarding the processing of personal data in unexpected ways, stating, “It is therefore only right that the ICO alerts people to the scale of this potential breach.”

Denham further noted that while UK data protection laws do not hinder the effective use of technology to combat crime, technology providers must respect and adhere to legal protections to maintain public trust and confidence. Clearview AI Inc. has halted its services in the UK, yet investigations indicate that it may have continued processing significant amounts of personal data without individuals’ knowledge.

Documents that leaked indicate that UK authorities, including the Metropolitan Police and the Ministry of Defense, had previously tested Clearview AI’s system, though it is reported that these trials are no longer occurring. Following the U.S. Capitol raid earlier this year, Clearview AI claimed that the use of its facial recognition technologies by law enforcement had increased by 26%.
