McDonald’s Drive-Thru AI Bot May Have Violated Privacy Law
Recently, McDonald’s announced that it is rolling out an AI chatbot to manage orders at its drive-thrus. However, this initiative may be in violation of privacy regulations. The chatbot is developed by Apprente, a voice recognition firm acquired by McDonald’s in 2019 and now operating under the name McD Tech Labs.
This technology has been implemented in ten locations in Chicago, Illinois, raising concerns. Illinois is known for its stringent data privacy laws, notably the Biometric Information Privacy Act (BIPA), which prohibits private entities from collecting biometric identifiers or information without informed consent.
Shannon Carpenter, a resident, has filed a lawsuit against McDonald’s on behalf of himself and fellow residents, claiming the fast-food chain has breached BIPA by failing to obtain explicit consent from customers to use their voice data. The lawsuit states, “Plaintiff, like other class members, is unaware of the status of his voiceprint biometrics acquired by the defendant.”
The AI software reportedly not only transcribes voice to text but also analyzes it to gather personal insights, including age, gender, accent, nationality, and origin. Furthermore, the plaintiff alleges that McDonald’s has been testing this AI technology at their drive-thrus since the previous year.
If found guilty of violating BIPA, individuals could receive up to $5,000 for each violation. Given the large customer base of McDonald’s, potential damages could surpass $5 million. This situation highlights the importance of ensuring that any AI applications adhere strictly to evolving data privacy regulations across different states and nations.
