Beijing Publishes AI Governance Rules

Chinese authorities have unveiled new regulations for generative AI that significantly exceed existing guidelines seen in other regions globally. A major stipulation is that operators of generative AI systems must ensure their services reflect core socialist values while avoiding content that could incite challenges to state authority, promote secession, terrorism, or undermine national unity and social stability.

Within China, generative AI systems are expressly prohibited from disseminating content that fosters ethnic hatred, discrimination, violence, obscenity, or disseminates false and harmful information. These regulations align with an earlier draft introduced in April 2023.

The newly published regulations also highlight China’s initiative to foster the creation of digital public goods for generative AI. Emphasizing the establishment of public training data resource platforms and collaborative model-making, the aim is to improve resource utilization rates. The regulations encourage a systematic classification of publicly available data and the expansion of high-quality training data resources.

Concerning technological development, the rules mandate the use of secure and proven tools, encompassing infrastructure like chips and software, in addition to computing power and data resources. Respect for intellectual property rights is crucial, as the consent of individuals must be secured before utilizing personal information. The regulations also prioritize the enhancement of quality, authenticity, accuracy, objectivity, and diversity in training data.

To promote fairness and prevent discrimination, developers are instructed to create algorithms that are unbiased concerning ethnicity, belief systems, region, gender, age, occupation, or health status. Furthermore, generative AI operators are generally required to obtain licenses for their services, ensuring a layer of regulatory oversight.

These new rules are set to take effect on August 15, 2023. China’s regulations will not only impact local AI operators but could also influence international conversations surrounding AI governance and ethical standards.
