EU Regulation Sets Fines for AI Misuse
A leaked draft of proposed EU regulations concerning artificial intelligence (AI) introduces significant penalties for misuse, potentially reaching up to €20 million or four percent of a company’s global turnover, whichever amount is greater. This regulation is expected to be officially announced on April 21st, as reported first by Politico.
The authors of the draft highlighted, “Some of the uses and applications of artificial intelligence may generate risks and cause harm to interests and rights protected by Union law. Such harm might be material or immaterial, relating to the safety and health of individuals, their property, or other fundamental rights and interests.” The proposed legal framework aims to encourage the development of AI while ensuring a high level of protection for public interests, particularly regarding health, safety, and fundamental rights.
While there is general agreement on the necessity of AI regulation, the scope of such controls remains a matter of debate. Insufficient oversight could endanger lives and privacy, especially with AI’s known bias issues. Conversely, excessive regulation might deter innovation and encourage AI research to relocate to countries with more lenient regulations. This concern echoes the discussions that surrounded the General Data Protection Regulation (GDPR) in the EU, which also imposed significant penalties for breaches.
In the past year, the White House has advised European allies to avoid imposing overly restrictive regulations on AI, emphasizing the need for a balanced and collaborative approach. They asserted that “the best way to counter authoritarian uses of AI is to ensure that America and our international partners remain the global hubs of innovation.”
The EU claims its approach to AI governance prioritizes human rights, attempting to find a middle ground between the unchecked practices seen in the US and dystopian surveillance methods employed in countries like China. The use of AI in policing is particularly contentious due to inherent bias concerns; however, it presents significant advantages in combating serious crime. The draft regulations propose allowing facial recognition technology in public spaces with stringent limitations regarding time and location.
Moreover, the proposed regulations include the establishment of a European Artificial Intelligence Board, comprising a representative from each EU member state, the EU’s data protection authority, and a member representing the European Commission. Updates on April 21st indicate that the fines in the draft have been increased to six percent of turnover, or €30 million, depending on which is greater.
