There is often a lack of detailed information about the training datasets employed for models such as GPT-4, which underpins platforms like ChatGPT. This ambiguity extends to how information gathered during user interactions is stored, creating potential legal and compliance challenges.

The risk of leaking sensitive company data through interactions with generative AI solutions is particularly alarming. Vaidotas Šedys, Head of Risk Management at Oxylabs, emphasizes, “Individual employees might leak sensitive company data or code when interacting with popular generative AI solutions.” While there’s no concrete evidence to suggest data submitted to ChatGPT is stored or shared, the possibility remains since new software often has unexamined security vulnerabilities.

OpenAI, the organization responsible for ChatGPT, has been cautious about disclosing how user data is managed, complicating efforts for businesses to prevent confidential code from being exposed. To mitigate risks, organizations may need to monitor employee activities closely and implement alerts regarding the use of generative AI platforms, which can be a burdensome task.

Additional risks arise from the potential use of incorrect or outdated information, particularly affecting junior specialists who may struggle to assess the AI’s produced output accurately. Many generative models are based on vast yet constrained datasets that require regular updates. OpenAI has acknowledged that its latest model, GPT-4, still presents issues with factual accuracy, which can lead to the spread of misinformation.

The implications of these risks extend beyond individual companies. For instance, Stack Overflow, a prominent developer community, has temporarily restricted the use of ChatGPT-generated content due to its low accuracy rates, which could misguide users seeking programming solutions.

Legal ramifications also emerge with the use of free generative AI tools. GitHub’s Copilot has already faced scrutiny and lawsuits due to allegations that it incorporates copyrighted code from public and open-source resources. “Since AI-generated code may include proprietary information or trade secrets belonging to another entity, companies could be held liable for infringing upon third-party rights,” Šedys explains. Furthermore, non-compliance with copyright regulations could impact a company’s valuation by investors if discovered.

While complete workplace surveillance is impractical, fostering individual awareness and responsibility remains vital. It’s essential to educate the public about the risks tied to generative AI solutions.

Collaboration among industry leaders, organizations, and individuals is necessary to tackle data privacy, accuracy, and legal risks associated with generative AI in workplace environments.
