New Regulations on Deepfakes in China Take Effect Today
China Enforces New Deepfake Regulations
As of January 10, 2023, China has initiated strict regulations concerning the production of deepfakes. These synthetically created media are often utilized for deceptive purposes, leading to manipulation and embarrassment. Notable instances include the misuse of deepfakes to impersonate figures like FTX founder Sam Bankman-Fried for fraud, Ukrainian President Volodymyr Zelenskyy for disinformation, and U.S. House Speaker Nancy Pelosi to present her in a compromised state.
Last month, the Cyberspace Administration of China (CAC) revealed measures aimed at curbing the proliferation of deepfakes. The CAC noted the rapid advancement of synthetic technologies, which, while enhancing user experience, has enabled criminals to create and spread harmful content, undermine reputations, and forge identities. Service providers responsible for generating synthetic content are now mandated to ensure that their AI tools are not exploited for illicit or damaging purposes.
Moreover, any AI-generated content must be distinctly labeled with a watermark. The newly enforced policies also stipulate that synthetic service providers must:
- Refrain from illegally processing personal data.
- Regularly assess and verify their algorithms.
- Implement management systems and technical protections.
- Authenticate users with genuine identity information.
- Establish channels for complaints and reporting.
The CAC emphasizes that the effective governance of synthetic technologies will require collaborative efforts from government bodies, businesses, and the public. This collective participation aims to foster legal and responsible practices in the use of deepfake technologies, while reducing the inherent risks.
